Terms of Service

These Terms of Service ("Terms") apply to the website novakitestudio.com and to every product listed on it (together, the "Services"). The Services are operated by TODO: legal entity name (ABNTODO), trading as NovaKite Studio ("we", "us"). By using the Services you agree to these Terms.

1. Using the Services

  • You must be at least 16 years old, or the age of digital consent where you live, to use the Services.
  • If you create an account, keep your login details secure. You are responsible for activity on your account.
  • Some products have their own additional terms or usage limits, which are shown on that product's site.

2. Acceptable use

You agree not to:

  • break any law, or infringe anyone's intellectual property, privacy or other rights;
  • upload content that is unlawful, sexually explicit involving minors, harassing, or hateful;
  • use the Services to create misleading content intended to deceive or impersonate real people;
  • attempt to reverse-engineer, overload, scrape or disrupt the Services, or get around usage limits;
  • resell or redistribute the Services without our written permission.

We may suspend or close accounts that break these rules.

3. Payments and subscriptions

  • Prices are shown on each product's pricing page before you pay. Taxes may be added where required.
  • Payments are processed by Stripe. We do not store your full card details.
  • Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time from your account or by emailing [email protected]; you keep access until the end of the period you have paid for.
  • If a free trial converts to a paid plan, we tell you the price and the date before the first charge.
  • Credits or usage allowances have no cash value and expire as described on the product's pricing page.
  • Refunds are covered by our Refund Policy.

4. AI-generated output

Some products use AI models to generate text, images, video or other output. AI output can be inaccurate or unexpected, so please review it before relying on it. Subject to your compliance with these Terms and the terms of the underlying model providers, you may use output you generate for any lawful purpose. You are responsible for how you use it.

5. Your content

You keep ownership of anything you upload. You give us a limited licence to store and process it only to provide the Services to you. We do not use your uploads to train AI models.

6. Our intellectual property

The Services, including their software, design and branding, belong to us or our licensors. These Terms do not give you any rights in them except the right to use the Services as described here.

7. Third-party names

Products may mention third-party games, platforms or AI models to describe compatibility. These names belong to their owners. Unless stated otherwise, our products are not affiliated with or endorsed by them.

8. Availability and changes

We work to keep the Services available but do not guarantee they will be uninterrupted or error-free. We may change, suspend or discontinue a product. If we discontinue a paid product, we will refund the unused part of any prepaid subscription.

9. Disclaimers and liability

The Services are provided "as is". To the extent allowed by law, we exclude all implied warranties and are not liable for indirect or consequential loss. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms excludes rights you have under consumer protection laws that cannot be excluded, including the Australian Consumer Law where it applies.

10. Ending these Terms

You can stop using the Services at any time. We may suspend or end your access if you seriously or repeatedly break these Terms. Sections that by their nature should survive (such as liability limits) continue to apply.

11. Governing law

These Terms are governed by the laws of TODO: governing law jurisdiction. You and we submit to the non-exclusive jurisdiction of its courts.

12. Changes to these Terms

We may update these Terms. If a change is significant, we will notify you by email or on the product site before it takes effect. The date at the top shows the latest version.
